Hello all. new to site and first post.
I know all stories have 2 sides but I will try to keep this as simple as I can. In my view this is another tape issue.
So home owner contracts me to add new solid site finished floors and refinish existing. Job goes on we get to point of staining and in the middle of staining a rain storm comes thru. We were not expecting it and all our gear is out in rain. We rush out get our stuff out of rain and go back into house...walking with wet shoes on prepped floor ( yes i know, super bad ). we go back re touch up those ares and finish staining. When stain is complete of course we have blotches. We went back resanded areas with blotches and got the floors back to where they should be. Home owner is happy in the end and makes final payment. i made sure all her concerns and any issues she had were taken care of before we got final payment. Floor was complete and finished with final payment on sept 10th. First week of Nov I get a call from home owner to come out and look at floor and there is an issue. So I go out and the poly is peeling.The home owner had painter come in after us to repaint the house. Now you can see where the tape has peeled the poly off the floor from where the painters put tape down. So about a 16 inch strip along all the walls has peeled up spots.
Home owner tells me the poly is bad and this is my fault and we need to fix it. I explained that I thought it was on the painter for using incorrect tape and explained the poly wasnt the issue. Any way we go back and forth for a bit. She doesnt want to deal with things during the holidays and calls me back in jan. Well we get into it again. Her saying its my fault and me saying I dont think so. Any way after a heated discussion just to be done I offer to screen and recoat the entire floor ( I thought it would be easier on me than taping each spot off and doing by hand ) I let her know I will get back with her when I check my schedule so we can schedule a time. I call back 2-3 days later with no answer. Finally a week later she calls back and says that it is now a stain issue. She has had other " floor guys" come in and this is what they have told her. She now wants me redo the entire floor or to pay her back the money to have the floor be resanded and stained and polyed. I told her I do not beleive the stain is an issue and explained I think the poly is the only issue and that I was willing to screen and recoat but that would be the extent i would go.
Well I have now been served a demand letter from her attorney. Obviously I am looking for my own legal help in case this does turn in to a law suit. Curious if anyone here has advise or recommendations for me. I feel like I have gone above and beyond with this home owner.
